Clothes, Energy, and Lawyer: COME BACK WITH A WARRANT not-a-single-fuck: soundssimpleright: supermansbuttocks: THUG LYFE This is actually what you should say to an ICE agent who has come to your house looking for an undocumented immigrant. Specifically, do not open the door; tell them to slide their warrant under the door. Read it carefully and check to see if it’s a JUDICIAL warrant, which will have specific information like the time and location where they’re allowed to search, and a specific description of who or what they’re allowed to search for. ICE practically *never* have this; they’ll have an ADMINISTRATIVE warrant, which is just their orders from their boss telling them to arrest a particular person. It does not give them the right to enter your house. ICE *can* enter your house if they have probable cause, such as if they see the person they’re looking for through a window or door (which is why you don’t open the door). Other forms of probable cause include kids telling agents that they were born outside of the US. Agents will trick people into chatting with them, especially kids who serve as translators for their parents, asking things like “What part of Mexico are you from?” Staying silent keeps the onus on them to prove in court later that they had evidence someone isn’t here legally. It’s important to remember that for now, at least, every person ICE wants to deport has to go before a judge, and ICE has to provide evidence that they know this person is undocumented and that they were arrested without violating the 4th amendment (against unreasonable search and seizure). We know that cops lie and that judges usually side with them, but agents would rather go for a sure bet from a targeted raid than risk wasting their time and energy on arrests that could be thrown out. For all of the questions I’ve gotten on this piece, 90% relate to the race/religion of Liberty and Justice. People are bothered by the perceived inaccuracies there and totally skip over the gay part. I imagine that Liberty and Justice kissing should, maybe, also be considered inaccurate because that’s actually where I took the biggest leap. I literally had no reason to do it except it’s that cute and gay and political. I personified the judicial system coming to protect the liberties of people legislatively marginalized for their race or religion…as two queer women. Yet somehow that is not the most inaccurate part to people. Why did you make liberty black and justice Muslim ?

So here’s a distilled explanation of Why Liberty Is Black and Why Justice Is Muslim for those who are confused by the rampant inaccuracies. I’ll spell it out.

The women I went up with today? Both were Arabs. One was from Pakistan, the other was from Lebanon (a Christian, a Muslim and a Jew walk into an airport…). When I asked them if I was overreacting by feeling like this was a coup-in-progress, they said no. That’s precisely what this is. I thought we had a coup-proof system. I was mistaken. Keep fighting the good fight, lawyers. And if you’re in Portland, I’ll see you at Perkins-Coie tomorrow at 5:30 for the L4GG meeting. At Dulles, CBP has been stonewalling four members of the US House of Representatives, the governer and attorney general of Virginia, and Senators Cory Booker (NJ) and Mark Warner (VA)–the latter of whom chewed out the head of CBP in person. No dice. Not even with a federal court order telling CBP at Dulles, only them, and them in particular to give detainees access to lawyers. And they’re pulling an old trick from the national-security handbook that’s been used to evade the courts on issues like domestic surveillance: “Lawyers and advocates still didn’t know how many people were being held in the secondary inspection area at Dulles or what their immigration status was, which led to a catch-22: Attorneys couldn’t file for contempt of court without having proof that legal residents were being detained and not being given access to lawyers, but they couldn’t get proof without getting access.” (x) At least two VA reps have found out (via friends and family) about constituents being detained at Dulles, at which point CBP released them in order to dodge the access-to-lawyers issue. The representative for my district is on the warpath–and also on the House Oversight Committee. Here’s hoping these fuckers get slapped with contempt of court so hard their ears ring, then get hauled in front of a committee hearing to see if they want to try their chances with contempt of Congress. All of which doesn’t even get into the Monday Night Massacre clusterfuck inside the executive branch, when the acting attorney general of the United States refused to make the DoJ defend the lawfulness of the immigration order in court. And was summarily fired and replaced with someone more compliant. So here’s also hoping the Senate puts Jeff Sessions through absolute hell on his role in all this before they vote to confirm him as AG. It’s like the civics lesson from hell. Yeah, um… about the Marshalls.  This is what’s been worrying me most since Saturday night, when reports started coming out of Dulles that CBP was ignoring court orders. This is awful and terrifying and I’m living in a hellscape I can’t escape from.

I had to return to Portland tonight because I have work tomorrow. ACLU  International Refugee Assistance Project attorneys will be back at SeaTac tomorrow at 5:30 a.m. (including my law school bestie, I am so proud). 
There were 13 people detained at SeaTac yesterday who were secretly transferred to a detention facility in Tacoma, so the Northwest Immigrant Rights Project is working with attorneys to straighten that right out. 
Basically: Shit is going down, y’all. The women I went up with today? Both were Arabs. One was from Pakistan, the other was from Lebanon (a Christian, a Muslim and a Jew walk into an airport…). When I asked them if I was overreacting by feeling like this was a coup-in-progress, they said no. That’s precisely what this is.
I thought we had a coup-proof system. I was mistaken.

At Dulles, CBP has been stonewalling four members of the US House of Representatives, the governer and attorney general of Virginia, and Senators Cory Booker (NJ) and Mark Warner (VA)–the latter of whom chewed out the head of CBP in person. No dice. Not even with a federal court order telling CBP at Dulles, only them, and them in particular to give detainees access to lawyers.
And they’re pulling an old trick from the national-security handbook that’s been used to evade the courts on issues like domestic surveillance: “Lawyers and advocates still didn’t know how many people were being held in the secondary inspection area at Dulles or what their immigration status was, which led to a catch-22: Attorneys couldn’t file for contempt of court without having proof that legal residents were being detained and not being given access to lawyers, but they couldn’t get proof without getting access.” (x)
At least two VA reps have found out (via friends and family) about constituents being detained at Dulles, at which point CBP released them in order to dodge the access-to-lawyers issue. The representative for my district is on the warpath–and also on the House Oversight Committee. Here’s hoping these fuckers get slapped with contempt of court so hard their ears ring, then get hauled in front of a committee hearing to see if they want to try their chances with contempt of Congress.
All of which doesn’t even get into the Monday Night Massacre clusterfuck inside the executive branch, when the acting attorney general of the United States refused to make the DoJ defend the lawfulness of the immigration order in court. And was summarily fired and replaced with someone more compliant. So here’s also hoping the Senate puts Jeff Sessions through absolute hell on his role in all this before they vote to confirm him as AG.
It’s like the civics lesson from hell.

Rockefeller, paying 94% tax, was still the richest man in the world and a philanthropist. Our government used the taxes to provide health, education, job training, low cost home loans and retirement benefits for our citizens. The graduated income tax (those with the greatest resources and incomes paid the most, those in the lower income levels paid the least) helped America become the richest nation with the largest middle class on earth. <p>Richard Nixon, Ronald Reagan, Dick Cheney and the Bushes cut the taxes on the richest among us, and the corporations they owned, to little or nothing, foisting upon us the ludicrous idea a few people, including themselves, should own our natural resources in a scheme they call “Privatization”. </p>
<p>After Kissenger/Cheney’s “Endless War” scheme, Privatization became the worst of their legacy. They put the fortune in tax dollars we paid for their phony “defense contracts”, into their offshore and Swiss Bank Accounts, starving our treasury to the tune of 17 Trillion Dollars and virtually eliminating the middle class. Cheney’s company, Halliburton, profits from his term as VP and President* Cheney says “Debt Doesn’t Matter”. It Doesn’t..To him. He got the money. His intention is to foist the “debt” onto you and me. Best we forgive the debt and move on. </p>

Restaurants, Grocery Stores, Hardware Stores, Resorts, Casino’s, laundries, Dry Cleaners, Liquor stores, retail outlets, auto manufacturing, etc. Anything that does not use public resources as its product. Should Jails be privately owned? No, they get all their money from the our public judicial system. Neither you, nor I, nor Corrections Corporation of America, have any right to own and operate prisons for profit. </p>
<p>Should you and I be able to have our own Private armies and the weapons of war? No. Neither you, I or Blackwater/XE, has any right to own armies or the weapons of war. That is a public function. Private “war contractors”, and their “for profit” mercenary soldiers, should be eliminated forever by cancelling and never reissuing all their “contracts”. </p>
